Brazil’s new pet custody law is about more than breakups—it reflects how family life is evolving across Brazil and beyond.

Under the new legislation, courts can now assign shared custody of pets when separating couples cannot agree. Judges will determine living arrangements and divide care costs, particularly when the animal has spent most of its life with both partners. It’s a clear shift away from treating pets as property toward recognizing them as part of the family.

This change mirrors reality. With roughly 160 million pets in Brazil, emotional bonds between people and animals have grown stronger, especially in households with fewer children. Lawmakers say the increase in disputes made it necessary for courts to adapt.

What makes the law significant is its focus on care. Judges must now consider responsibility, routine, and wellbeing—not just ownership. It also includes safeguards, denying shared custody in cases involving violence or criminal history.

Ultimately, Brazil isn’t just updating legal language. It’s acknowledging a broader cultural shift—one where family is no longer defined solely by blood or marriage, but by connection, care, and everyday life.
